Terms of Service for PostSwift

1. Description of PostSwift

PostSwift is a social media management application that allows creators and businesses to publish and schedule content across supported social media platforms, including TikTok, Instagram, YouTube, Bluesky, and LinkedIn.

PostSwift may provide features including:

• Immediate publishing
• Post scheduling
• Cross-platform publishing
• AI-generated captions and descriptions
• Image and video uploads
• Content management
• Social media account connections
• Other features that may be added in the future

Features and supported platforms may change over time.

2. Eligibility

You must be at least 16 years old to use PostSwift.

By using the PostSwift application, you represent that you meet this age requirement and have the legal capacity to agree to these Terms.

3. PostSwift Accounts

You are responsible for maintaining the security of your PostSwift account and for all activity that occurs through your account.

You agree to provide accurate information when creating your account and to keep your account information up to date.

PostSwift does not request or store your social media passwords. Connections to supported social media platforms are made through the official authorization systems provided by those platforms.

You are responsible for maintaining the security of your connected social media accounts.

4. Third-Party Platforms

PostSwift integrates with third-party social media platforms, including TikTok, Instagram, YouTube, Bluesky, and LinkedIn.

Your use of these third-party platforms remains subject to their respective terms of service, privacy policies, and other applicable rules.

PostSwift does not control third-party platforms and cannot guarantee their availability, functionality, policies, or continued support for PostSwift.

Third-party platforms may change their APIs, policies, permissions, or requirements, which may affect PostSwift functionality.

5. Billing and Subscriptions

PostSwift may offer free trials and paid subscription plans.

Paid PostSwift subscriptions are processed through Stripe and may automatically renew according to the subscription plan you select unless you cancel before the next billing period.

Cancellation prevents future renewals but generally does not terminate access immediately. Your subscription will remain active until the end of the current billing period unless otherwise stated.

6. Refunds

PostSwift offers a 7-day refund policy.

Refund requests may be reviewed on a case-by-case basis.

PostSwift may deny refund requests involving fraud, abuse, repeated refund requests, chargeback misuse, or violations of these Terms.

7. User Content

You retain ownership of the content you upload, create, schedule, or publish through PostSwift ("User Content").

By using PostSwift, you grant Scruums LLC a limited, non-exclusive license to access, process, store, transmit, and publish your User Content solely as necessary to provide the PostSwift services you request.

This license ends when the User Content is deleted or your account is terminated, except where retention is required by law or reasonably necessary for legitimate business purposes.

You are responsible for ensuring that you have the necessary rights, permissions, and licenses for any content you upload or publish through PostSwift.

8. Acceptable Use

You agree not to use PostSwift to:

• Violate any applicable law or regulation
• Publish spam or unsolicited content
• Infringe copyrights, trademarks, or other intellectual property rights
• Impersonate another person or organization
• Distribute malware or malicious software
• Conduct phishing or fraudulent activities
• Abuse or attempt to circumvent platform restrictions
• Publish content that violates the policies of connected social media platforms
• Attempt to gain unauthorized access to PostSwift or another user's account
• Interfere with the operation or security of PostSwift
• Use PostSwift for unlawful or abusive purposes

We may restrict or suspend access to PostSwift if we reasonably believe that an account is violating these Terms or creating a security, legal, or operational risk.

9. Privacy

Your use of PostSwift is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

10. Service Availability

We aim to keep PostSwift available and reliable, but we do not guarantee uninterrupted or error-free operation.

PostSwift does not guarantee:

• Continuous availability of the service
• Successful publication of every post
• Availability of third-party platforms
• Availability of specific features
• Social media reach or engagement
• Follower growth
• Algorithmic performance
• Specific business or marketing results

Third-party platform changes, outages, restrictions, or policy changes may affect PostSwift's functionality.

11. Intellectual Property

The PostSwift application, website, software, branding, logos, designs, features, and other materials provided by Scruums LLC are owned by or licensed to Scruums LLC and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, reverse engineer, reproduce, or create derivative works from PostSwift or its proprietary materials.

Your User Content remains yours.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Scruums LLC and PostSwift will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the PostSwift application or services.

This includes, without limitation, losses resulting from:

• Lost revenue
• Lost profits
• Lost data
• Failed publications
• Social media account restrictions
• Third-party platform outages
• Changes to third-party platform policies
• Loss of followers or engagement
• Business interruption

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

13. Termination and Suspension

You may stop using PostSwift and cancel your account at any time.

Scruums LLC may suspend or terminate your access to PostSwift if you:

• Violate these Terms
• Engage in fraudulent or abusive activity
• Create a security risk
• Violate applicable laws
• Violate the policies of connected platforms

Upon termination, your right to use PostSwift will end.

Certain provisions of these Terms, including provisions concerning intellectual property, limitations of liability, and governing law, may continue to apply after termination.

14. Changes to These Terms

We may update these Terms of Service from time to time.

When significant changes are made, we may update the Effective Date and may notify users through the PostSwift application, website, or email.

Your continued use of PostSwift after updated Terms become effective constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to its conflict-of-law principles.
